Terms of Service

1. Acceptance
By accessing or using the Aviontive Box workspace at box.aviontive.com (the "Service"), you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
2. Accounts & Access
You must provide accurate information, safeguard your credentials, and promptly notify us of any unauthorized use. You are responsible for all activity under your account.
3. Connected Channels
You may connect Instagram business accounts and other channels. You grant us permission to use the necessary tokens and API permissions to read messages, send replies, and provide inbox features as configured within the Service.
4. Customer Data & Ownership
You retain ownership of your messages, media, brand content, and configuration ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide the Service and related support.
5. AI Features
The Service may generate automated replies, summaries, and system-state categorizations using third-party AI. Outputs may be imperfect; you are responsible for review where applicable. We disclaim warranties as to accuracy, reliability, or fitness for a particular purpose.
6. Acceptable Use
You may not use the Service for unlawful activity, harassment, deception, spam, malware, unauthorized scraping, reverse engineering, or interfering with networks or APIs.
7. Third‑Party Services
Instagram/Meta, Google Gemini, Supabase, and other vendors have their own terms and policies. Your use of such services via the Service is subject to those terms.
8. Fees & Billing
If you subscribe to paid plans, you agree to the posted pricing and billing terms. Fees are non‑refundable unless required by law.
9. Suspension/Termination
We may suspend or terminate your access for breach, security risks, non‑payment, or legal compliance. You may terminate at any time by deleting your account.
10. Disclaimers
The Service is provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability shall not exceed the amounts you paid to us in the 12 months preceding the claim (or $100 if none).
12. Indemnification
You agree to defend and indemnify us from claims arising from your use of the Service or violation of these Terms.
13. Governing Law; Disputes
These Terms are governed by the laws of Delaware, USA (without regard to conflicts rules). Courts located in Delaware have exclusive jurisdiction, and you consent to personal jurisdiction there.
14. Changes
We may update these Terms from time to time. Continued use after changes means acceptance of the updated Terms.
